How much will your claim cost?

Costs can range from a few hundred pounds for advice and assistance on a possible claim to much higher sums when disputing the validity of a Will or when pursuing proceedings for an Inheritance Act claim for a spouse or dependant. If you are successful in your claim you should recover most of your costs, however, this is not always the case and the Court has the power to make a range of different cost orders.

However, don't be under any illusions – these types of claim are expensive and if a claim is issued and you are unsuccessful then you may have to pay the costs of the other party. There is always a cost risk in bringing such claims, but see what we say about insurance options below.

If you are unable to fund your claim privately, other funding options can be considered. We can act on a 'no win no fee' basis, but please note we only offer this option in a very limited number of cases and we usually require a barrister's opinion that you have good prospects of success before we will agree to act on a no win no fee basis. The barrister may also agree to act on a no win, no fee basis.

We can also advise on the use of insurance products to cover the cost of pursuing a claim. However, we should warn you that many policies include exemptions that prevent legal expenses cover being issued for will or inheritance dispute related claims. It is possible that you may already have the benefit of "before the event" legal expenses insurance under an existing household or stand alone policy – we can investigate this for you.

If you think you may be eligible for Legal Aid please visit the Direct Gov website but please be aware that advice on a Will dispute is not one of the areas for which legal aid is normally granted, other than for Inheritance Act claims, which come under the Family area of Legal Aid.
